A brief statement of the nature of the suit is as follows, to-wit; On or about July 21, 2022 at approximately 2:13pm, Defendant Ortega-Pineda was the unlicensed driver of a large 1997 Mack truck, VIN 1M1AA07YXVW010987 (hereinafter referred to as “the Truck”). On the date of incident, Defendant Ortega-Pineda was an employee of Defendant Mauro Ortega Construction, Defendant Ortega, Defendant RAR, Defendant Rodriguez, Defendant Alliance Trucking, Defendant Guido Trucks, and/or Defendant Ibarra, and was within course and scope of his employment with Defendants. Defendants hired Defendant Ortega-Pineda to drive the Truck to and from various construction sites. On the date of the incident, the Truck was registered to Defendant Gonzalez. Defendant Gonzalez was the owner and operator of Defendant Alex Gatt Trucking. On the date of incident, the Truck was being used to conduct business by Defendant RAR, Defendant Ortega, Defendant Mauro Ortega Construction, Defendant Alliance Trucking, Defendant Rodriguez, Defendant Guido Trucks, and/or Defendant Ibarra. While driving the Truck, Defendant Ortega-Pineda was traveling northbound on Coit Road at Frontier Road, and intersection in Prosper, Collin County Texas. Defendant Ortega-Pineda ran the red light at the intersection of Coit Road and Frontier Road, colliding with Tammy Meyer as she lawfully crossed through the intersection traveling westbound on Frontier Road. Tammy Meyer was taken to the hospital, but later succumbed to her injuries and passed away, leaving behind her surviving spouse and the father of her children, Plaintiff Stephen Meyer, her two children, Plaintiff Sean Meyer, and Plaintiff R.M., and her father, Plaintiff Tommy C. Wade, Sr. Defendant Ortega-Pineda was distracted, inattentive, and struck Tammy Meyer’s vehicle resulting in life-threatening injuries to Tammy Meyer, from which she eventually passed away. After the crash, Defendant Ortega-Pineda attempted to flee the scene of the crash. Defendant Ortega-Pineda was 100% at fault for causing this crash because he was not paying attention to the traffic signals and road ahead. Defendant RAR, Defendant Mauro Ortega Construction, Defendant Ortega, Defendant Gonzalez, Defendant Alex Gatt Trucking, Defendant Rodriguez, Defendant Alliance Trucking, Defendant Guido Trucks, and Defendant Ibarra are vicariously liable for the acts and/or omissions of Defendant Ortega-Pineda, as is more fully shown by Plaintiff’s Petition on file in this suit. At same time and place, Defendants were each operating vehicles behind Plaintiffs. When traffic began to slow to a stop, Plaintiffs reduced speed. Defendants failed to control speed, failed to keep a proper lookout, and rear-ended Plaintiffs in a four-car pile-up. This collision caused severe injuries to Plaintiffs. On or about May 21, 2022, Plaintiffs were traveling northbound on Westmorland Road in Dallas, Texas. Suddenly and without warning, Defendant Alicia Rodriguez, while operating a vehicle owned by Defendant Juan Cervantes, failed to control her speed and struck the rear of Plaintiffs’ vehicle. This collision caused severe injuries to Plaintiff Young, as is more fully shown by Plaintiff’s Petition on file in this suit.
